1. Acceptance of these Terms
These Website Terms of Use (“Terms”) govern your access to and use of www.callservtt.com and other CallServ webpages that link to these Terms (collectively, the “Website”). The Website is owned and operated by CallServ Limited (“CallServ,” “we,” “us” or “our”). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
2. Website purpose; no client engagement
The Website provides general information about CallServ, its capabilities, career opportunities and related topics. Website content is not a binding offer, professional advice, guarantee, service-level commitment or client contract. Any services provided by CallServ are governed exclusively by a separate written agreement signed by authorized representatives of the parties. If these Terms conflict with a signed client agreement concerning the contracted services, the client agreement controls for those services.
3. Eligibility and authority
You may use the Website only if you are legally able to enter into these Terms. If you use the Website on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
4. Permitted use
CallServ grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Website for lawful informational, business or employment-related purposes. You may download or print reasonable portions of the Website for internal, non-commercial reference, provided that you retain all copyright and proprietary notices.
5. Prohibited conduct
You must not: (a) use the Website in violation of law or another person’s rights; (b) attempt to gain unauthorized access to the Website, systems, accounts or data; (c) interfere with security, integrity, availability or performance; (d) introduce malware or harmful code; (e) scrape, harvest, crawl or use automated means to access content except as permitted by law and our robots instructions; (f) reverse engineer or attempt to derive source code except where such restriction is prohibited by law; (g) impersonate another person or misrepresent affiliation; (h) submit unlawful, deceptive, infringing, abusive or malicious content; or (i) use Website content to train, develop or improve a machine-learning or artificial-intelligence model without CallServ’s prior written permission.
6. Intellectual property
The Website and its content, including text, graphics, logos, photographs, audio, video, software, design, compilation and trademarks, are owned by or licensed to CallServ and are protected by applicable intellectual-property laws. “CallServ” and associated marks may not be used without prior written permission. No right or licence is granted except the limited Website-use right expressly stated in these Terms.
7. Information you submit
You remain responsible for information you submit through the Website. You represent that you have the right to provide it and that it is accurate and lawful. You grant CallServ a non-exclusive right to use, reproduce and process the submission as reasonably necessary to respond to you, administer recruitment, protect the Website or carry out the purpose for which it was submitted, in each case subject to our Privacy Policy. Do not submit confidential client data, regulated data, payment-card information, health information, government identifiers or other sensitive information through a general Website form unless CallServ expressly requests it through an approved channel.
8. Careers
Job postings are invitations to apply and do not constitute an offer or promise of employment. Positions, requirements and availability may change or be withdrawn at any time. Submission of an application does not guarantee an interview, assessment, offer or response. Recruitment information is handled as described in our Privacy Policy and any notice presented during the application process.
9. AI, voice and demonstration features
The Website may describe or provide access to AI-enabled, voice, chatbot or demonstration features. Outputs may be generated automatically and may be incomplete or inaccurate. Do not rely on a demonstration for legal, medical, financial, safety-critical or other professional decisions. Where an interaction may be recorded, transcribed or analyzed, CallServ will provide notice as required. You must not use a demonstration to submit another person’s personal information without authority or to test unlawful, harmful or confidential content.
10. Third-party links and services
The Website may link to third-party websites, tools or services. CallServ does not control and is not responsible for their content, availability, security, terms or privacy practices. Links are provided for convenience and do not constitute endorsement. Your use of a third-party service is governed by the third party’s terms.
11. Privacy and cookies
Our Privacy Policy explains how we handle personal information. Our Cookie Preferences page explains how cookies and similar technologies are used and how you can manage choices. Those documents are incorporated into these Terms by reference.
12. Website availability and changes
We may modify, suspend, restrict or discontinue any part of the Website at any time. We do not guarantee that the Website will always be available, uninterrupted, secure or error-free. We may correct errors and update content without notice.
13. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” CALLSERV DISCLAIMS ALL EXPRESS, IMPLIED AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY AND UNINTERRUPTED AVAILABILITY. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLSERV AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL LOSS, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, DATA OR USE, ARISING FROM OR RELATED TO THE WEBSITE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLSERV’S AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE WEBSITE WILL NOT EXCEED US$100. These limitations do not apply to liability that cannot lawfully be limited or excluded.
15. Indemnity
To the extent permitted by law, you agree to defend, indemnify and hold harmless CallServ and its directors, officers, employees and affiliates from claims, losses, liabilities, damages, costs and expenses, including reasonable legal fees, arising from your unlawful use of the Website, your material breach of these Terms or content you submit in violation of another person’s rights. This section does not apply to the extent a claim results from CallServ’s own unlawful conduct.
16. Governing law and jurisdiction
These Terms and any non-contractual obligations arising from them are governed by the laws of the Republic of Trinidad and Tobago, without regard to conflict-of-laws principles. Subject to any mandatory rights that apply where you live, the courts of Trinidad and Tobago have exclusive jurisdiction over disputes arising from or relating to the Website or these Terms.
17. Changes to these Terms
We may update these Terms from time to time. The revised Terms take effect when posted unless a later date is stated. Your continued use of the Website after the effective date constitutes acceptance of the revised Terms.
18. General
If any provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent. These Terms, together with the Privacy Policy and Cookie Preferences page, constitute the entire agreement concerning use of the Website, except where a separate signed agreement applies.
